For some New Yorkers, back to business as usual

Despite power outages, flooding and a crippled transportation system, New Yorkers stepped out into the streets Wednesday, trying to regain their daily fast-paced rhythm.?

Getting to work?
The sun was not up yet over Central Park and torn branches and debris from Superstorm Sandy were still scattered along Fifth Avenue as several New Yorkers huddled around a bus stop on the Upper East Side. They lined up as the bus approached, and, as a woman wearing scrubs took the first steps into the bus, the driver stopped her from paying the fare.?

?It?s free today,? she said.?

Buses and taxis were only a small part of the traffic crisscrossing streets at a brisk and, at times, busy pace for 6:45 a.m. The congestion became a serious concern as the day progressed, and Wednesday afternoon New York Mayor Michael Bloomberg said he would restrict car traffic coming into Manhattan to vehicles carrying three or more passengers until Friday.?

While some bus service resumed and some bridges reopened, transit officials said they couldn't predict when the entire subway would be fully restored. New York Gov. Andrew Cuomo said that parts of the subway would begin running again Thursday morning.?


On Broadway?
Many of Broadway?s 40 theaters, which had been closed Monday and Tuesday, were open Wednesday, but "The Lion King," "Mary Poppins" and ?Evita? were among the performances that were canceled. That sent several dozen people ? mostly tourists ? to Minskoff Theater, where they waited in an orderly line at the box office to sort out their tickets.?

Museums, the Empire State Building and many stores also reopened Wednesday but parks, the 9/11 Memorial, the Statue of Liberty, Ellis Island and many other top attractions remained shuttered.?

At the New York Stock Exchange?
Financial markets reopened after a two-day shutdown, with Bloomberg ringing the opening bell at the New York Stock Exchange.

If you took a quick glance at the neighborhood around the exchange, you would have thought it was a normal Wednesday morning on Wall Street. Traffic was moving, and a combination of locals, exchange workers and tourists populated the sidewalks.?

But this was no typical morning. No stores or restaurants were open -- not even a Starbucks. The traffic light at the corner of Broadway and Wall Street was dark; there was no power anywhere. ?

The only building within view that had electricity was the iconic New York Stock Exchange, which has always been heavily fortified, with backups upon backups, lest the edifice of American capitalism be compromised.?

The building ?- lit red, white and blue -- stood out against the rest of the Financial District, which was pitch black before dawn.?

Exchange workers began showing up slowly, some working on connecting their firms with the trading floor.?

"We'll have to run the servers from the floor," one worker said to another.?

Others walked around looking for a good cell signal.?

As the morning went on, traffic built up, and more workers arrived, some by taxi, some by limo, others in vans or buses.?

Many left behind difficult circumstances at home caused by the massive storm.?

"I need to find a whole-house generator," a security guard said. His house was without power, and he had toddlers at home.?

"You and me, we live through it," he said. "But the babies, they don't understand."?

Two exchange workers walked past. One pumped his fist. "We're back," he said. "We're back!"?

?Our biggest challenge is ensuring that everybody around here is taken care of because of the power outages,? he said.?

A couple of blocks away, a deli worker who had poked a hole in a pizza box, wrote ?open? in big letters across the front and put the box around his neck was standing in front of the Gramercy Star Caf?, hoping to attract customers to one of the very few open businesses on that block.?

The deli was without power, but the gas stoves were working, so kitchen staff worked by candlelight, making sandwiches and baking pastries.?

In the East Village
Vincent Sgarlato?s restaurant, ?11B Express,? was closed Wednesday and dealing with a flooded basement, but residents in the neighborhood told us the pizzeria had given out free slices for most of the day Tuesday.?

Sgarlato said that once the restaurant lost power, he decided not to let the pizza dough go to waste. He and his team spent more than seven hours baking more than 125 pies, he said, which they sliced and gave away to whomever wandered in the restaurant.?

?It felt so good to do it,? Sgarlato, who opened the pizzeria about six years ago, told NBC News, adding that people wanted to give him tips but he couldn?t take them.?

?I don?t have the heart to do that,? he said.

The feds want the location records of MetroPCS and T-Mobile cell phone customers in Texas without bothering to show that a crime was even committed. The U.S. Attorney in Houston asserts that cell phone users have no reasonable expectation of privacy as to their location, and he wants to have the data without showing a search warrant.

So far, a federal magistrate and a federal judge have said "no."

But the feds persist in a live case before the Fifth Circuit federal appeals court. In Re: Applications of the USA, No. 11-20884. The authorities assert that getting your location from a cell phone company is like asking for your recent charges from a credit card issuer, or requesting your latest transactions from your bank, or getting business records from your landlord.

It's not an invasion of privacy for a routine investigation, they say.

Fortunately the Electronic Frontier Foundation, the Electronic Privacy Information Center and the ACLU argue the contrary -- that people do, in fact, want their cell phone location to be private. For example, iPhone users raised hell after Apple revealed in 2011 that the phones stored a 10-month record of a user's location. The company revised its operating system to correct the problem.

Months of Data About Your Location

Did you know that every time you use your cell phone to check email, send a text or make a call, your cell phone relays your location to the cell phone company? And that the company keeps your data for months? 88 percent of adult Americans own cell phones, and the average person uses it 50 times a day.

With your location data the feds can build a profile of your social, political and personal life. They will know your movements, habits, relationships, activities and religious affiliation. Shouldn't the government have to show probable cause that a crime was committed? Shouldn't it have to get a search warrant?

In fact:

  • Customers don't knowingly or voluntarily disclose their location to cell phone companies. It's generated automatically.

  • Customers can't control the type and amount of data collected. The date, the time, the duration and the location of every call are recorded.

  • Cell companies keep months of comprehensive location records about customers.

  • Customers are not notified when their records are handed over to law enforcement without probable cause.
A recent survey found that 77 percent of cell phone users did not want app developers to know their location, according to Harris Interactive -- much less the federal authorities.

It's time to draw the line: the Fourth Amendment gives you an expectation of privacy about your location when you use your cell phone. This is personal information and the feds should have to show a search warrant to get it.

Regardless of how the Fifth Circuit rules, this issue will have to be decided by the U.S. Supreme Court. I reported here two months ago that the Sixth Circuit federal appeals court gave the government access to cell phone location records without a warrant. That conflicts with a 2010 decision by the Third Circuit federal appeals court, which required the government to get a search warrant for location records.

Americans are losing their right to privacy every day. Your right to be free of unreasonable searches will be badly damaged if the government can track you down without even showing a crime was committed. Nobody signed up for a two-year contract to be monitored when they got a cell phone.

EU sends Microsoft formal antitrust complaint

BRUSSELS (AP) ? The European Union's executive arm formally accused Microsoft on Wednesday of failing to comply with a binding agreement to give customers a choice among Internet browsers.

In 2009, the European Commission said it suspected Microsoft of using its dominant market position to foist its Internet Explorer browser on users. In negotiations, Microsoft agreed to create a screen where users could choose among competitors' browsers. The Commission accepted that concession and made the creation of a "browser choice screen" legally binding.

But in July, the Commission said the screen had not been displayed on many computers between February 2009 and July 2012, and millions of users may have been affected during that period. At the time, Microsoft said that a technical error was responsible.

EU Competition Commissioner Joaquin Almunia said any breach would be a "serious infringement," noting that the settlement between the EU and Microsoft had allowed the company to avoid lengthy antitrust proceedings and being held liable.

"Companies should be deterred from any temptation to renege on their promises or even to neglect their duties," he said.

On Wednesday, the company apologized for the error and said it was working to make sure it didn't happen again,

"We take this matter very seriously and moved quickly to address this problem as soon as we became aware of it," Microsoft said in a statement. "Although this was the result of a technical error, we take responsibility for what happened."

Microsoft will now be given four weeks to respond to the formal complaint and can seek an oral hearing. Once it has assessed Microsoft's defense, the Commission will rule.

The company could face a fine of up to 10 percent of its annual revenue if found in breach of antitrust law.

New Jersey teens charged with murder

The body of a missing 12-year-old girl was found in a recycling bin not far from her home on Monday. Two brothers have been charged, though the motive is still unclear.?

The boys, ages 15 and 17, were charged with murdering Autumn Pasquale, who disappeared while riding her BMX bike Saturday, a little more than a week before what would have been her 13th birthday. She appeared to have been strangled, Gloucester County prosecutor Sean Dalton said at a late-day?news?conference.

The boys' mother had come forward with information about a posting on a son's Facebook account, Dalton said. He wouldn't say what was on the website or discuss a possible motive for the killing, but said there was no sign of sexual assault.

Autumn was lured to the house, where they apparently lived with their mother and stepfather, for the purpose of getting parts for her treasured BMX bike, which she rode frequently and talked about on her Facebook pages.

Both brothers were charged with counts including first-degree murder, body disposal and tampering with evidence. The 15-year-old was also charged with luring.

The boys' names were not released because they are juveniles, but Dalton said his office is considering trying to have the case transferred to adult court. The boys turned themselves in with their attorneys, public defenders, but it could not be immediately determined who they are.

The?girl's?body was found around 10 p.m. Monday in a recycling bin on a vacant property next to the home where the boys live, police said. The suspects had attended a community vigil for her shortly before the discovery, several residents said.

Autumn's BMX bike and other belongings were recovered from the boys' home, the prosecutor said. He did not detail all the items, but a backpack matching a description of the?girl's?was also seen being taken out.

One of the three teenage brothers who friends said live at the house traded BMX bike parts, according to a according to a young man, Corey Hewes, 19, who said he was among those who traded with him.

Neighbors also said the house was a place where teens frequently hung out and had parties.

The home is just blocks from Autumn's house and from the town hall, where thousands of people gathered for the tearful candlelight vigil to pray for her safe return in this town of 8,000 about 25 miles (40 kilometers) south of Philadelphia.

(AP) ? Indiana Republican Senate candidate Richard Mourdock refused to apologize Wednesday for saying that rape resulting in pregnancy is "something God intended."

State Republicans and a few congressional leaders defended Mourdock, whose prospects of winning the seat long held by the GOP are unclear.

Mourdock, meanwhile, dove into damage control Wednesday, explaining that he abhors violence of any kind and regrets that some may have misconstrued and "twisted" his comments. But he stood behind the original remark in Tuesday night's debate.

"I spoke from my heart. And speaking from my heart, speaking from the deepest level of my faith, I would not apologize. I would be less than faithful if I said anything other than life is precious, I believe it's a gift from God," Mourdock said at a news conference Wednesday.

GOP presidential hopeful Mitt Romney's campaign quickly said he disagrees with Mourdock's initial remarks, but Romney did not cancel a television ad in which he endorses the Senate candidate. New Hampshire Sen. Kelly Ayotte canceled an event scheduled for Wednesday with Mourdock.

But Senate Republican leader Mitch McConnell and Texas Sen. John Cornyn issued statements of support, acutely aware that Mourdock's fortunes in Indiana could hold the key to winning control of the Senate. Republicans must gain four seats if President Barack Obama is re-elected, three if Romney prevails.

In Indiana, it wasn't supposed to be this way. Mourdock's upset of veteran Republican Sen. Richard Lugar in the May primary created an opening for Democrats looking to fight for what would have otherwise been a safe GOP seat. The surprisingly close race between Mourdock and Democrat Joe Donnelly has spurred national Republicans to send more money and national stars to Indiana recently in an attempt to hold the seat.

Although Ayotte cancelled plans to headline a fundraiser for Mourdock in Indianapolis, the Indianapolis Republican Women Club pushed on with the fundraiser. Speaking inside the closed-door event, Indiana Republican Party Chairman Eric Holcomb declined to comment on Mourdock's explanation Wednesday and said the loss of Ayotte from the trail Wednesday would not slow their efforts to elect Mourdock.

"I think we're moving full steam ahead," he said.

Mourdock's rape comment seemed to fall a few steps short of Republican U.S. Rep. Todd Akin's comment earlier this summer that a woman's body would block against pregnancy in cases of "legitimate rape," both in terms of the comment itself and its potential impact in the race.

National Republican and conservative groups, including Crossroads GPS, the National Republican Senatorial Committee and the Club for Growth, continued their on-air assault against Donnelly. A Democratic source tracking ad buys nationally said Wednesday there was no effort from Mourdock supporters to pull out of the state, as there was in Missouri, following Akin's comments.

Democrats capitalized on the remarks Wednesday, holding press calls and press conferences and cutting Web ads tying Romney to Mourdock. Donnelly appeared in downtown Indianapolis in front of the Julian Center, which counsels victims of rape, sex trafficking and abuse.

"It is hurtful to women, to survivors of rape and to their families," Donnelly said. "His words were extreme, but more important, hurtful to victims of sexual abuse."

Mourdock refashioned himself at the end of the summer, moving away from the tea party rhetoric that carried him to victory over Lugar and attempting to refocus the race on Donnelly's vote in support of the federal health care law.

Throughout a political career that dates back to the 1980s, Mourdock always has maintained that he opposes abortion except in cases where the life of the mother is at risk.

Donnelly opposes abortion but supports exceptions for rape, incest and the life of the mother. However, the Democrat was among more than 200 lawmakers, most of them Republicans, who backed legislation last year that would have cut off federal aid for abortion services, even in cases of rape and incest. A spokeswoman later said the congressman didn't realize the bill would go that far.

It was still unclear Wednesday whether Mourdock's comments would hurt his chances in Indiana, a state that has increasingly become dominated by social conservatives over the last few election cycles. A federal appeals court blocked the Indiana General Assembly's effort to defund Planned Parenthood earlier Tuesday and state lawmakers will likely consider legislation next year to allow the teaching of Creationism.

No jail time in first sentence for FAMU hazing death

The first of 12 defendants in the deadly hazing case of Florida A&M drum major Robert Champion was sentenced by an Orlando court on Monday.

Brian Jones, 23, avoided a jail term, but was sentenced to six months of community supervision ? a strict monitoring arragement?that requires an ankle monitor and frequent check-ins with probation officials ? followed by two years of probation. He is also required to do 200 hours of community service, The Associated Press reported.

The band had traveled to Orlando from Tallahassee to perform at a football game when the fellow band members subjected Champion to a severe beating on the bus ? in a ritual called "crossing Bus C" ? which caused him to fall unconscious, and then die, on Nov. 19, 2011.

?


Jones, a percussionist, faced up to five years in prison and a $5,000 fine. But the judge said Jones? role had been relatively limited.

"This young man's part in this horrible act ... as compared with many others from what I've seen is minimal," said Judge Marc Lubet, ruling in?Orange County Court. "It was an isolated incident in this man's life for which he's shown remorse."

Lubet quoted Abraham Lincoln as he announced the sentence, saying that "mercy bears richer fruit than strict justice," the Orlando Sentinel reported.

After initially pleading not guilty, Jones entered a no-contest plea Oct. 9 to a third-degree felony hazing charge.

Champion?s parents attended Monday's court proceedings. Prior to the sentencing, his mother challenged the idea that Jones? role had been minor:

"You and I know that's not true," said Pam Champion, addressing Jones, and carrying a picture of her son. "You played a critical role."

"You won't be able to put it out if your mind...It will haunt you," she told Jones.

Here's a quick overview of how StumbleUpon works. You create an account, input some information about yourself, and hit the "stumble" button to see a random page from the Web that meets your interests. For example, one of my interests on StumbleUpon is journalism, and when I explored for content recently in that vein, I found a TED Talk called "The news about the news," as well as a page from the Newseum's website showing front pages of major newspapers today. These previews help you decide when to wait for the page to load and when to keep stumbling, and the design here really mitigates any problem with page loading because at least you have something on screen. Page loading speeds only become noticeable in the more detailed sections of the app, like when you drill down to view content related to only one particular interest, or when you want to view only the pages you've marked as "like" in StumbleUpon. In my experience with the app, those pages took much longer to load, and the preview pane disappeared after a few seconds, leaving me looking at a blank page and progress bar at the top that filled ever so slowly.

A sharing button gives you the most appropriate options first: send a link via email, share with another StumbleUpon user, post to Facebook or Twitter, and open in Safari. Gone are a few options that were previously available in the app, like read a page in Google Reader and save to Instapaper or the Read it Later app, which I would guess got nixed as a result of not enough Stumblers using them. With these save-for-later features kaput, I wish the Safari option had a one-touch ability to add it to the Safari reading list, as I often wanted to mark pages to read later and didn't like having to open the page in Safari first before saving it to the reading list.
